Introduction

Welcome to our Marketplace! These Terms and Conditions govern your use of our platform, including the creation of accounts, buying and selling of watches, and your interactions with other users. By accessing or using our marketplace, you agree to comply with these Terms.

Account Registration

In order to use certain features of our marketplace, you must create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you suspect any unauthorized use of your account, you must notify us immediately atsupport@websterwatches.com.

User Responsibilities

As a user of our marketplace, you agree to the following responsibilities:

• Ensure that all information you provide is accurate and up-to-date.
• Use the marketplace for lawful purposes only and in compliance with all applicable laws and regulations.
• Do not engage in any fraudulent or illegal activities, including selling counterfeit or stolen goods.
• Respect the rights of other users and do not engage in any harassment, threats, or abusive behavior.
• Ensure that you manage your transactions and shipping in accordance with marketplace rules.

Buying and Selling Watches

By listing a watch for sale, you represent and warrant that:

• You own the watch or have the right to sell it on the platform.
• The watch is accurately described and free of defects (unless explicitly stated).
• All transactions are subject to marketplace terms, and you agree to comply with any applicable laws regarding the sale of goods.

You agree to handle the shipping and delivery of the items you sell. We do not offer shipping services. You are responsible for ensuring that the items reach the buyer securely and promptly.

Buyers agree to make payment through the provided payment options, including Stripe, which handles all payment processing.

Payment Processing

All payments on the marketplace are processed securely via Stripe. By using the platform to buy or sell, you agree to Stripe’s Terms of Service and Privacy Policy, which govern the processing of payment transactions.

As a seller, you will be charged two fees per successful transaction:

• Marketplace Fee: A flat fee of $5.00 CAD, which covers platform operation and support. This fee is deducted from the seller’s payout.
• Stripe Processing Fee: Stripe charges 2.9% + $0.30 CAD per transaction for Canadian-issued cards. This fee is deducted by Stripe directly and is subject to change based on Stripe’s policies.

The remaining balance after both fees are deducted will be transferred to the seller via Stripe’s payout system. We are not responsible for delays, holds, or issues caused by Stripe.

Communication and Notifications

We may use SendGrid to send notifications and emails to users for various purposes, including transaction confirmations and updates. By using our marketplace, you consent to receiving such communications.

Prohibited Activities

You may not use the platform to:

• Sell counterfeit, illegal, or stolen goods.
• Engage in fraudulent activities or manipulate transactions.
• Harass, threaten, or harm other users.
• Upload or distribute malicious code or viruses.
• Violate any intellectual property rights, including copyrights and trademarks.

We reserve the right to suspend or terminate your account if you engage in any of these prohibited activities.

Limitation of Liability

Our marketplace is provided 'as is' and we make no representations or warranties regarding the accuracy, reliability, or completeness of the content and services offered. We are not liable for any losses, damages, or claims arising out of your use of the platform or any transactions.

We are not responsible for any disputes between buyers and sellers. By using the platform, you agree to resolve such disputes directly with the other party.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the platform, including your breach of these Terms or violation of any applicable laws.

Termination

We reserve the right to suspend or terminate your access to the marketplace at any time for any reason, including violation of these Terms. You may also terminate your account by contacting us atsupport@websterwatches.com.

Changes to These Terms

We may update these Terms and Conditions from time to time. Any changes will be posted on this page with the updated date. You are encouraged to review these Terms periodically to stay informed about our policies.
